The General Purchase Conditions set out below, (hereinafter, the "GC"), regulate the online retail store service of items with the registered trademarks CALLAGHAN® and GORILA®, (hereinafter, the "Items " or, individually, the “Article”), accessible from the website ”www.callaghan.es”.

The General Purchase Conditions are made up of the following sections:

If you are interested in purchasing one of the CALLAGHAN® and GORILA® Items through the online store service, you will acquire the status of customer (hereinafter, the "Customer"), so please read the following conditions carefully before to start the purchasing process.

Public service hours are Monday to Thursday from 9:00 a.m. to 1:30 p.m. and from 3:00 p.m. to 6:00 p.m. and Friday from 9:00 a.m. to 2:00 p.m. The telephone support languages ​​are Spanish and English.

The official claim forms are available to Customers in any of the CALZADOS RETRAK, SL stores.

2.- GENERAL CONDITIONS OF PURCHASE AND ITS ACCEPTANCE.
The Calzados Retrak online store service is subject to these GTC, which are complemented by the general conditions of access and use of the website “www.callaghan.es”, which the Client must consult through the “Legal Notice” , of the aforementioned portal prior to accessing the online store and which will be inexorably linked to these GTC with its acceptance by the Client.

In the event that the aforementioned general conditions of access and use of the website “www.callaghan.es” contain clauses that contradict these GTC, the latter will take precedence over the former.

As a Client, you declare that you are of legal age and have sufficient legal capacity to be bound by these GTC when contracting with Calzados Retrak.

To make a purchase through the Calzados Retrak online store, it will be necessary for the Customer to register or have previously registered and accept these GTC. Likewise, the Client must accept the CGC again at the end of the purchase process in the version published by Calzados Retrak at the time of carrying out the last transaction.

Consequently, Calzados Retrak reserves the right to modify the commercial offer presented on the website and its CGC (modifications to products, prices, costs, promotions and other commercial conditions), those CGC being applicable to the purchase made by the Client. that you would have accepted at the end of the purchase process, by clicking on the tab with the heading “I accept the General Purchase Conditions”.

3.- COVERAGE OF THE ONLINE STORE.
The online store service is intended for end consumers, in the sense established by Royal Legislative Decree 1/2007, of November 16, of the Consumers and Users Law. Therefore, wholesale companies, distributors, purchasing centers, large stores, or other intermediaries in the footwear sector are excluded from the service.

By virtue of the above, the resale of Items purchased through the online store is completely prohibited.

The Items offered through the Calzados Retrak online store are distributed in Austria, Belgium, Denmark, Spain, France, Greece, Holland, Italy, Portugal, Ireland and Sweden.

4.- THE ARTICLES AND INFORMATION PROVIDED ON THE WEBSITE.
All the items offered on this website are a selection of products from the collection for men and women of the registered brands CALLAGHAN® and GORILA®.

Each Item is accompanied by the following information: Name of the Item, images of the Item, description of the Item, collection to which the Item belongs, available sizes, price (tax included) and shipping costs.

CALZADOS RETRAK makes every effort within its means to offer the information contained on the website truthfully and without typographical errors, as well as to show the colors of the Articles in the most faithful way to reality as possible. However, the color of the Items displayed on the screen may be subject to variations depending on the quality of the Customer's computer monitor.

However, if the written information provided through the website does not correspond to the reality of the Item, the Customer will have the right to cancel their purchase without any cost on their part.

5.- PURCHASE AND REGISTRATION PROCEDURE.
A) REGISTRATION: To make a purchase through the Calzados Retrak online store, it is necessary for the Client to register in advance and open a customer account. Consequently, the Client must complete the registration form which can be accessed by clicking on the links called "Register" and "Create account". Once the Customer is registered, their data will be saved for future purchases.

B) CHOICE: Subsequently, the Client must select the desired Item by clicking on its image, being able to see the image, description and available sizes below.

Once the desired Item has been chosen, the Customer must choose the size and click the “Add to cart” link.

C) MY BASKET: Once the selection is completed, the customer can continue the purchasing process or can select a new product by clicking “Continue shopping”.

Once the Client has selected all the Items they wish to purchase, they must check that their details appearing in the basket are correct (photo, model, number, pairs).

Likewise, the basket will show the price of each Item (tax included), the total purchase price and the shipping costs.

The order must be confirmed by clicking “Next” to then choose the payment method.

D) PAYMENT METHOD: To select the payment method, the application will ask the Client for the data corresponding to the email and password of their client account. Next, the Client must select the desired payment method.

If you choose to pay with PayPal, you will be redirected to PayPal so you can pay with your PayPal account or your debit or credit card quickly and securely, without sharing financial information.

For payments by credit or debit card (Visa and Mastercard), the charge will be made in real time through the payment gateway of the financial institution BBVA, once the authenticity of the data communicated has been verified.

The payment gateway system used offers maximum security and payment data is transmitted directly and in encrypted form (SSL) to the corresponding financial institution.

For the transfer payment option, all expenses derived from said operation will be borne by the Client. In order to be able to make the payment using this option, the following current account number opened in the entity, “BBVA”, in the name of CALZADOS RETRAK, SL is provided:

In the concept, the Client must state his name and order number. Payment must be made within five business days from the date the order was placed.

In the case of payment by bank transfer, only the proof of deposit into the CALZADOS RETRAK account will serve as a payment letter, and not the proof - transfer order. Consequently, the order will not be considered accepted until it is effectively confirmed that the payment has been received. If after the indicated period, CALZADOS RETRAK has not received the corresponding amount, the purchase will be cancelled.

A 3% surcharge will be applied to cash on delivery purchases on the total amount of the order, with €2.42 being the minimum applicable amount. This payment method is only available for orders sent to Spain.

E) CONFIRM: Once the payment method has been selected, and before sending the order, the Customer will be able to view a summary of the shipping data, the payment method and their order.

The order must be confirmed by clicking on the "Confirm order" link.

Confirmation of receipt of the order will be communicated through the website, indicating the order number so that the Customer can track it through the “My orders” link located within their user account.

Likewise, an email message will be sent with a description of the order.

CALZADOS RETRAK does not ship to PO boxes.

6.- CURRENCY AND APPLICABLE TAXES.
The prices in the Calzados Retrak online store are shown in euros.

The website will offer the Customer all the information about the price and characteristics of the Items before completing the purchase process.

Prices in euros include 21 percent VAT.

7.- SHIPPING COSTS AND DELIVERY TIMES.
Shipping costs for Items purchased through the online store will be borne by the Customer. Its amount is the following:
  • Peninsular Spain and the Balearic Islands: €3 - €3.70 - €1, depending on the service chosen.
  • If the purchase is more than €40, shipping will be free.
  • Austria, Belgium, Denmark, France, Greece, Holland, Italy, Portugal, Ireland and Sweden: €10.
  • If the purchase is over €140, shipping will be free.
Upon confirmation that payment has been processed, the estimated shipping time is as follows:

  • For shipments to Peninsular Spain, the Balearic Islands and Portugal: 1-3 working days with MRW or Correos Express and 7-10 working days with Correos.
  • 3-6 business days for Austria, Belgium, Denmark, France, Greece, Holland, Italy, Ireland and Sweden. The transport company UPS will be used to deliver these shipments.
Orders will be shipped during business hours. Therefore, to avoid delivery incidents, the Customer must indicate the address where the order can be delivered during these hours, as well as a contact telephone number.

Calzados Retrak does not ship to PO boxes or CityPaqs.

If for reasons of force majeure the order cannot be delivered, the full purchase amount will be refunded.

The Calzados Retrak online store is not responsible for delays in cases of force majeure, such as the interruption of activity or total or partial strike of postal services and means of transport or communications, floods or fire.

8.- RETURNS OR EXCHANGES OF PURCHASED ITEMS.
If for any reason the Customer is not satisfied with the purchased Item, they may return it within a period of 30 business days, counting from the delivery date.

The law of the place where the Article was delivered will determine the days that are to be considered business days.

In order to exercise the right of return or exchange, it is essential that the items have not been used and that they retain their labels. The product must be returned in the same condition in which it was sent and, whenever possible, in its original packaging, and may be replaced with one of a similar size.

Changes:
  • The first size or model change on orders sent to Peninsular Spain or the Balearic Islands is free.
  • For changes to orders sent to Austria, Belgium, Denmark, France, Greece, Holland, Italy, Portugal, Ireland and Sweden, the customer will bear the shipping costs. Once we receive the item, we will contact the customer to manage the change.
Returns:

Once the merchandise is received, CALZADOS RETRAK will refund the total amount by bank transfer to the current account number that the Client indicates in the RETURN FORM or, where applicable, to the credit card number that was used to make the purchase.

The Customer will be responsible for the return shipping costs. Returns with postage due will not be accepted.

9.- WARRANTY
The product warranty in case of defect is 2 years from the date of delivery. The USER must report the lack of conformity within a period of 2 months from when they became aware of it.

10.- SECURITY POLICY.
For the purposes of Organic Law 15/1999, of December 13, on the Protection of Personal Data, (hereinafter, the LOPD), the Client is informed that the data obtained as a result of the purchase process will be incorporated into a file. duly registered in the General Data Protection Registry, whose responsible and recipient is CALZADOS RETRAK “by this: Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and the rights to that the client can revoke their consent are: access, rectification, deletion, limitation of processing or portability of data.

The transactions carried out between Calzados Retrak and the Client will be archived by the former.

Likewise, the Customer has the possibility of tracking orders placed during the last year by clicking on the “My orders” link, located within their user account.
