The General Conditions of Purchase set out below (hereinafter, the "GTC"), regulate the online store service for the retail sale of items bearing the registered trademarks CALLAGHAN® and GORILA® (hereinafter, the "Articles" or, individually, the "Article"), accessible from the website "www.callaghan.es".
The General Conditions of Purchase are composed of the following sections:

If you are interested in purchasing one of the CALLAGHAN® and GORILA® items through the online store service, you will acquire the status of customer (hereinafter, the "Customer"), so we ask you to read the following conditions carefully before starting the purchasing process.
1.- IDENTIFICATION AND CONTACT DETAILS OF THE SERVICE PROVIDER.
The GTC regulate the sale of products on the website "www.callaghan.es" or online store presented by the commercial entity, "CALZADOS RETRAK, SL", whose identifying details are as follows:
Company name: CALZADOS RETRAK, SL, entity authorized to carry out the official online store service for products with the registered trademarks CALLAGHAN® and GORILA®, (hereinafter, “CALZADOS RETRAK”).

The office hours are Monday through Thursday, 9:00 a.m. to 1:30 p.m. and 3:00 p.m. to 6:00 p.m., and Friday, 9:00 a.m. to 2:00 p.m. Telephone support is available in Spanish and English.
The official complaint forms are available to Customers at any CALZADOS RETRAK, SL store.
2.- GENERAL CONDITIONS OF PURCHASE AND THEIR ACCEPTANCE.
The Calzados Retrak online store service is subject to these GTC, which are supplemented by the general conditions of access and use of the website "www.callaghan.es", which the Customer must consult through the "Legal Notice" of the aforementioned portal prior to accessing the online store and which will be inexorably linked to these GTC upon their acceptance by the Customer.
In the event that the aforementioned general conditions of access and use of the website "www.callaghan.es" contain clauses that contradict these GTC, the latter shall prevail.
As a Customer, you declare that you are of legal age and have sufficient legal capacity to be bound by these GTC when contracting with Calzados Retrak.
To make a purchase through the Calzados Retrak online store, the Customer must register or have previously registered and accept these Terms and Conditions. Furthermore, the Customer must accept the Terms and Conditions again at the end of the purchase process, in the version published by Calzados Retrak at the time of the last transaction.
Consequently, Calzados Retrak reserves the right to modify the commercial offer presented on the website and its GTC (modifications to products, prices, costs, promotions and other commercial conditions). The GTC that the Customer had accepted at the end of the purchase process by clicking on the tab labeled "I accept the General Conditions of Purchase" will apply to the purchase made by the Customer.
3.- ONLINE STORE COVERAGE.
The online store service is intended for end consumers, as established by Royal Legislative Decree 1/2007, of November 16, on the Consumer and User Law. Therefore, wholesalers, distributors, purchasing centers, large retailers, and other intermediaries in the footwear sector are excluded from the service.
By virtue of the foregoing, the resale of items purchased through the online store is strictly prohibited.
The items offered through the Calzados Retrak online store are distributed in Austria, Belgium, Denmark, Spain, France, Greece, the Netherlands, Italy, Portugal, Ireland, and Sweden.
4.- THE ARTICLES AND INFORMATION PROVIDED ON THE WEBSITE.
All items offered on this website are a selection of products from the men's and women's collections of the registered trademarks CALLAGHAN® and GORILA®.
Each item is accompanied by the following information: Item name, images of the item, description of the item, collection to which the item belongs, available sizes, price (taxes included) and shipping costs.
Calzados Retrak makes every effort, within its means, to offer the information contained on the website truthfully and without typographical errors, as well as to display the colors of the Items as accurately as possible. However, the color of the Items appearing on screen may vary depending on the quality of the Customer's computer monitor.
However, if the written information provided through the website does not correspond to the reality of the Item, the Customer has the right to cancel their purchase at no cost to them.
5.- PURCHASE AND REGISTRATION PROCEDURE.
A) REGISTRATION: To make a purchase through the Calzados Retrak online store, the Customer must first register and open a customer account. Therefore, the Customer must complete the registration form, which can be accessed by clicking on the links labeled "Register" and "Create Account." Once the Customer has registered, their information will be saved for future purchases.
B) CHOICE: The Customer must then select the desired item by clicking on its image, and will then be able to see the image, description and available sizes.
Once the desired item has been selected, the Customer must select the size and click the “Add to Cart” link.
C) MY BASKET: Once the selection is complete, the customer can continue the purchasing process or select a new product by clicking “Continue Shopping”.
Once the Customer has selected all the Items they wish to purchase, they must check that the details of the Items appearing in the basket are correct (photo, model, number, pairs).
The price of each item (including taxes), the total purchase price, and shipping costs will also be displayed in the shopping cart.
The order must be confirmed by clicking “Next” to then choose the payment method.
D) PAYMENT METHOD: To select the payment method, the application will ask the Customer for their account email and password. The Customer must then select their preferred payment method.
If you choose to pay with PayPal, you'll be redirected to PayPal so you can pay with your PayPal account or with your debit or credit card quickly and securely, without sharing any financial information.
For credit or debit card payments (Visa and Mastercard), the charge will be made in real time through the BBVA financial institution's payment gateway, once the authenticity of the information provided has been verified.
The payment gateway system used offers maximum security, and payment data is transmitted directly and encrypted (SSL) to the corresponding financial institution.
For the payment option by bank transfer, all expenses arising from this transaction will be borne by the Customer. For the purposes of making payment via this option, the following current account number is provided, open at BBVA, in the name of CALZADOS RETRAK, SL:

The Customer must include their name and order number in the statement. Payment must be made within five business days of the order being placed.
In the case of payment by bank transfer, only the receipt of deposit into the CALZADOS RETRAK account will be valid as proof of payment, not the transfer order receipt. Consequently, the order will not be considered accepted until the payment has been effectively confirmed. If CALZADOS RETRAK has not received the corresponding amount after the indicated period, the purchase will be cancelled.
Cash-on-delivery purchases will be subject to a 3% surcharge on the total order amount, with €2.42 being the minimum applicable. This payment method is only available for orders shipped to Spain.
E) CONFIRM: Once the payment method has been selected, and before the order is sent, the Customer will be able to view a summary of the shipping information, the payment method, and their order.
The order must be confirmed by clicking the "Confirm Order" link.
Confirmation of order receipt will be sent via the website, indicating the order number so the Customer can track it using the "My Orders" link located within their user account.
An email message will also be sent with a description of the order.
RETRAK FOOTWEAR does not ship to PO boxes.
6.- CURRENCY AND APPLICABLE TAXES.
Prices in the Calzados Retrak online store are shown in euros.
The website will provide the Customer with all the information regarding the price and characteristics of the Items before completing the purchasing process.
Prices in euros include 21 percent VAT.
7.- SHIPPING COSTS AND DELIVERY TIMES.
Shipping costs for items purchased through the online store will be borne by the Customer. The costs are as follows:
- Peninsular Spain and the Balearic Islands: €3 - €3.70 - €1, depending on the service chosen.
- If the purchase is over €40, shipping will be free.
- Austria, Belgium, Denmark, France, Greece, Holland, Italy, Portugal, Ireland and Sweden: €10.
- If the purchase is over €140, shipping will be free.
After confirmation that the payment has been processed, the estimated shipping time is as follows:
- For shipments to mainland Spain, the Balearic Islands, and Portugal: 1-3 business days with GLS or Correos Express.
- 3-6 business days for Austria, Belgium, Denmark, France, Greece, the Netherlands, Italy, Ireland, and Sweden. UPS will be used for delivery.
Orders will be shipped during business hours. Therefore, to avoid delivery issues, the Customer must provide the address where the order can be delivered during these hours, as well as a contact telephone number.
Retrak Footwear does not ship to PO Boxes or CityPaqs.
If the order cannot be delivered due to force majeure, the full purchase amount will be refunded.
The Calzados Retrak online store is not responsible for delays in cases of force majeure, such as interruption of activity or total or partial strike of postal services and means of transport or communications, floods, or fire.
8.- RETURNS OR EXCHANGES OF PURCHASED ITEMS.
If for any reason the Customer is not satisfied with the purchased Item, they may return it within 30 business days from the delivery date.
The law of the place where the Article has been delivered will determine the days that are to be considered working days.
To exercise the right of return or exchange, it is essential that the items are unused and retain their tags. The product must be returned in the same condition as when it was sent and, whenever possible, in its original packaging. It may be replaced with a similar size.

Changes:
- The first size or model exchange for orders shipped to mainland Spain or the Balearic Islands is free.
- For orders shipped to Austria, Belgium, Denmark, France, Greece, the Netherlands, Italy, Portugal, Ireland, and Sweden, the customer will be responsible for shipping costs. Once we receive the item, we will contact you to arrange the exchange.
Returns:
Once the merchandise has been received, CALZADOS RETRAK will refund the total amount by bank transfer to the current account number indicated by the Customer on the RETURN FORM or, where applicable, to the credit card number used to make the purchase.
The customer will be responsible for return shipping costs. Returns with postage due will not be accepted.
However, if the return of the Item is due to a defect or flaw in the Item, please contact Customer Service at +34 941380297, +34 650901447, or by email at tiendaonline@callaghan.es to process the return.
To proceed with the return of the product, the Customer must fill out the RETURN FORM that can be found at the following link: Form

9.- WARRANTY
The product warranty in case of defects is two years from the date of delivery. The user must report any lack of conformity within two months of becoming aware of it.
10.- SECURITY POLICY.
For the purposes of Organic Law 15/1999, of December 13, on the Protection of Personal Data, (hereinafter, the LOPD) the Client is informed that the data obtained as a result of the purchase process will be incorporated into a file duly registered in the General Registry of Data Protection, whose responsible and recipient is CALZADOS RETRAK "by this: Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and the rights to which the client can revoke their consent are: access, rectification, deletion, limitation of treatment or portability of data.
11.- COOKIES AND LINKS.
The User is informed that the WEBSITE uses cookies for the sole purpose of storing certain USER data so that it is not constantly requested. These cookies, or small data files that the browser stores on the USER's hard drive, are temporary and are deleted from the computer when the browser session is closed and/or, in any case, expire after 30 minutes. Three types of cookies are used:
1- Cookies strictly necessary for the provision of certain services expressly requested by the user: if these cookies are deactivated, you will not be able to correctly receive our content and services.
2- Analytical cookies (for monitoring and statistical analysis of the behavior of all users), advertising cookies (for managing advertising spaces based on criteria such as the frequency with which ads are displayed) and behavioral cookies (for managing advertising spaces according to the user's specific profile): if these cookies are deactivated, the website may continue to function, although the information collected by these cookies about the use of our website and the success of the ads displayed on it allows us to improve our services and obtain income that allows us to offer you many contents free of charge.

The information obtained through these cookies, relating to the user's device, may be combined with your personal data only if you are registered on this website.
HERGAR is not responsible for the content and veracity of the privacy policies of third parties included in this cookie policy.
HERGAR is not the owner of other websites that may be accessed through links or hyperlinks on the WEBSITE. Consequently, the USER accesses their respective content and conditions of use under his or her sole responsibility.
12.- TRANSACTION FILE.
Transactions between Calzados Retrak and the Client will be archived by the former.
Additionally, the Customer has the option to track orders placed over the past year by clicking on the "My Orders" link located within their user account.
